Mocha Habits · Version 1.0 · Effective [DATE YOU PUBLISH]

The agreement between you and us about using the app. Plain English, and it means what it says.

Three things still to fill in Your full legal name, your trade licence number and issuing authority, and the effective date. Everything else is final — but have a UAE-qualified lawyer read sections 7 and 11 before you rely on them. This is a careful draft written against what the app actually does; it is not legal advice.

1. Who this agreement is with

These terms are between you and [YOUR FULL LEGAL NAME], trading as Mocha Habits, established in the United Arab Emirates under trade licence [LICENCE NUMBER] issued by [ISSUING AUTHORITY]. By creating an account or using Mocha Habits you agree to them. If you do not agree, do not use the app.

2. What Mocha Habits is — and what it is not

Mocha Habits is a habit-tracking and self-reflection app. It includes an AI coach that talks about habits, routines and consistency.

It is not healthcare. The AI coach is not a therapist, counsellor, doctor or crisis service, and nothing in the app is medical advice, diagnosis or treatment. It will not diagnose a condition, comment on medication, or replace a professional. If you are struggling with your mental health, please talk to a qualified person. If you are in immediate danger, call your local emergency number — 998 for ambulance in the UAE, 999 for police. In the US you can call or text 988 (Suicide & Crisis Lifeline); elsewhere, findahelpline.com lists services by country.

The coach is an AI. It can be wrong, and it can misread you. Treat what it says as a prompt to think, not as instruction. Decisions you make about your health, work, relationships or finances are yours.

The coach is deliberately limited. It refuses medical, medication, legal and financial questions, it declines to help build habits that would harm you — severe food restriction, drinking to cope, exercising to injury, punishing yourself — and it points you to real help instead. These limits are not negotiable and we will not remove them on request.

3. Your account

You must be 16 or older to create an account.
Give us an email address you control, and keep your password to yourself. You are responsible for what happens under your account.
One account per person. Do not share it.
Tell us promptly at [email protected] if you think someone else has got into it.

4. Your content belongs to you

Everything you write — journal entries, coach conversations, habit names, reflections — is yours. We claim no ownership and no licence to use it.

As set out in the Privacy Policy, most of it never reaches us at all: your journal, your coach conversation, your mood and your reflections stay on your device. This means we cannot recover them for you. If you lose your phone or delete the app without exporting, that content is gone, and there is nothing we can do. Export regularly from Settings → Export your data.

5. Fair use

Do not:

use the app for anything illegal under the laws of the UAE or your own country, or to harm yourself or anyone else;
try to get the AI coach to produce harmful, sexual, hateful or illegal content, or to act outside what it is for;
use the coach as a general-purpose AI assistant — it is scoped to habits, and requests outside that are refused;
attempt to break, overload, reverse-engineer or bypass the security of the app or its servers;
use automated means to access the service, or resell access to it;
share, script against or otherwise abuse your credentials or our API.

We may suspend or close an account that does these things. Where it is reasonable to do so we will tell you why first.

6. Subscriptions and payment

Mocha Habits has a free tier and a paid Premium subscription.
Subscriptions are sold and billed by Apple or Google, not by us. We never see your payment details.
Subscriptions renew automatically at the price shown at purchase, until you cancel. Cancel any time in your App Store or Google Play account settings — cancelling stops the next renewal and keeps your access until the end of the period you have paid for.
Refunds are handled by Apple and Google under their own policies, not by us. We cannot issue a refund for a store purchase.
If you are a consumer in the UK or EU you have a statutory right to cancel a digital purchase within 14 days, subject to the store's own process and to the exceptions that apply once you have started using the content. Consumers in the UAE retain their rights under Federal Law No. 15 of 2020 on Consumer Protection.
We may change prices. Existing subscribers get at least 30 days' notice, and a price change never applies to a period already paid for.

7. Availability, and what we are responsible for

We work to keep the app running, but we do not promise it will be available without interruption or free of errors. We may change or discontinue features. If we discontinue the service entirely, we will give you reasonable notice and time to export your data.

To the fullest extent the law allows:

the app is provided "as is", without warranties beyond those that cannot be excluded;
we are not liable for indirect or consequential loss, lost profits, or lost data — including content held only on your device;
our total liability to you in any 12-month period is limited to what you paid us in that period, or AED 500 if that is greater.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.

8. Ending the agreement

You can stop at any time: delete your account in Settings → Delete account. That erases everything we hold, permanently and immediately. Deleting your account does not by itself cancel a subscription billed by Apple or Google — cancel that in the store as well.

We may end this agreement if you materially breach these terms, or if we stop operating the service.

9. Our intellectual property

The app, its name, its design and its content (other than yours) belong to us. You get a personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, redistribute or create derivative works from it.

10. Changes to these terms

We may update these terms. For material changes we will notify you in the app at least 30 days before they take effect. Continuing to use the app after that means you accept the new version. If you do not accept it, delete your account before the effective date.

11. Governing law

These terms are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of [EMIRATE], and the courts of [EMIRATE] have exclusive jurisdiction.

If you are a consumer resident in the UK or the EU, this does not deprive you of the protection of the mandatory laws of your country of residence, or of your right to bring proceedings there.
